P-Account and Garnishment Exemption Limit

Seizure exemption limits for employment income are adjusted by the Federal Ministry of Justice and Consumer Protection every two years, valid from July 1st, in accordance with the development of the basic tax amount (Section 32 a Paragraph 1 No. 1 EStG) and published in the Federal Law Gazette (Section 850 c ZPO).

The basic amount is €1,133.80 per month and serves to ensure the minimum subsistence level and the statutory maintenance obligation, if this exists. Beneficiaries are biological children or spouses with little or no income of their own. The amount of the allowance is divided into monthly, weekly and daily net income as well as the number of maintenance obligations. However, if seizure is due to a maintenance obligation, the statutory exemption limits do not apply and the court determines an individual exemption amount (§ 850 d ZPO). Certain income such as child benefit, expense allowances, hazard pay and child-care allowances cannot be seized (§§ 850 a, 850 b ZPO). In the case of overtime and holiday pay, 50% can be seized. This also applies to Christmas bonuses, which may not exceed the maximum limit of €500.00.

If an account has been seized or is expected in the future, every natural person has the right to a P account; a second or even third P account is not permitted. It should also be noted that spouses are not allowed to have a joint P account. By changing the current account to a P account, you automatically have the base amount of €1,133.00. A certificate from a suitable body (e.g. debt advice center or lawyer) proves the maintenance obligation and accordingly the need for a higher seizure exemption limit. For one person with maintenance obligations, the exemption amount is €1,569.99 per month, for two maintenance obligations it is €1,799.99 per month and for three people with maintenance obligations, the seizure exemption limit has been set at €2,039.99 per month. The additional amount of €3,475.79 can be seized without restriction.

After the debtor submits an application to the responsible enforcement court, an order for non-seizability for a period of up to 12 months or an increase in the non-seizable amount (§§ 850 l sentence 1 ZPO, 850 f para. 1 ZPO) can be determined. The prerequisites for an application for non-seizability are if the debtor proves that predominantly non-seizable amounts were credited in a period of six months prior to the application and that this can also be expected in the next 12 months. An increase in the exemption amount is possible if the remaining income after the seizure is not sufficient to cover needs, for example in the case of an increased maintenance obligation or increased costs due to illness.
